MyAnnita LLC respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512), MyAnnita responds to notices of claimed copyright infringement regarding material made available through its platform.

1 Designated Agent

MyAnnita LLC has designated the following agent to receive notifications of claimed copyright infringement. This agent is registered with the United States Copyright Office under registration number DMCA-1079795.

2 Filing a notice of claimed infringement

To be effective under 17 U.S.C. § 512(c)(3), a written notification must include substantially the following:

• A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
• Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works.
• Identification of the material that is claimed to be infringing and information reasonably sufficient to permit MyAnnita to locate it, such as the specific URL.
• Information reasonably sufficient to permit MyAnnita to contact the complaining party, including an address, telephone number and, if available, an email address.
• A statement that the complaining party has a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

Notices that do not substantially comply with these requirements may not be actionable. Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees.

3 What MyAnnita does upon receiving a valid notice

Upon receipt of a notice that substantially complies with the requirements above, MyAnnita will expeditiously remove or disable access to the material claimed to be infringing, and will take reasonable steps to notify the user who made the material available that it has been removed or disabled.

4 Counter notification

If you believe that material you posted was removed or disabled by mistake or misidentification, you may send a counter notification to the Designated Agent. To be effective under 17 U.S.C. § 512(g)(3), it must include substantially the following:

• Your physical or electronic signature.
• Identification of the material that was removed or disabled and the location at which it appeared before it was removed or access to it was disabled.
• A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
• Your name, address and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located — or, if your address is outside of the United States, for any judicial district in which MyAnnita may be found — and that you will accept service of process from the person who provided the original notification or an agent of that person.

Upon receipt of a valid counter notification, MyAnnita will forward it to the complaining party. Unless that party notifies MyAnnita that it has filed an action seeking a court order to restrain the allegedly infringing activity, the removed material may be restored between 10 and 14 business days after receipt of the counter notification.

5 Repeat infringers

MyAnnita has adopted and reasonably implements a policy providing for the termination, in appropriate circumstances, of the accounts of users who are repeat infringers of copyright. MyAnnita keeps a record of notices received and of the measures adopted in response.

6 Trademark and other rights

Claims regarding trademarks, rights of publicity, privacy or any matter other than copyright are not handled through this procedure. Please direct those claims to hola@myannita.com.
